This Privacy Policy is an integral part of our Site and cannot, in any way, be separated from the Users Agreement or from the usage or transaction process. If you do not agree to our Privacy Policy in whole, you must not use the Site. Consent

BY SUBMITTING PERSONAL INFORMATION TO US, AND/OR BY USING OUR SITE, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW.

If you do not agree with these terms, do not provide any personal information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required personal information, we may not be able to provide you with services that can be offered on our Site.

Information Collection

Registered Users

We collect information volunteered by consumers when they register and make requests through our Web site. If you choose to register with ClickEats.com you will be asked to provide your name, email address, password, and password validation. This information is collected on the registration form for several reasons including: (1) personal identification; (2) restaurant reservations or orders; and (3) to allow us to contact you for customer service, if necessary.

If making an Online Food Order, we will ask additional information to complete your order. The information may include, but is not limited to, your delivery address, contact phone number, credit card type, credit card number, credit card expiration date, credit card security code, backup contact name, and backup contact phone number.

When you return to the site and login, we use your account information to provide you with access to your request history. In addition, your email address is collected to send you an email message confirming your new user registration. As a member, you can sign up to receive updates from us about special offers, new clickeats.com services, and other news and announcements. However, you may always choose to decline to receive these email messages at any time. Please see our Opt-out policy described below. If you make an Online Food Order, a copy of your order will be saved under your account on ClickEats.com.

Unregistered Users

Unregistered users will be asked to provide personally identifiable information including a name and a telephone number in order to complete the reservation, as you usually would be when making a reservation over the phone. In addition, you will be asked to provide an email address to which ClickEats will send automated service messages pertaining to your reservation.

How We Use Your Information

ClickEats will never sell, rent, loan or otherwise distribute any of your personal information (including but not limited to your name, email address, phone number or any other identifiable information about you) to any third party without your prior expressed written consent, although we will pass certain information on to restaurants to fulfill your request, only as described below.

Online Orders

Online Ordering requires registration. Registered Users receive an email message confirming their status as a Registered User. Registered Users can view and update their account information (My Account), and view their transaction history in the My Requests section of the Site.

To complete your order, you provide information depending on the type of order you are making, which may include: your name, email address, contact phone, delivery address (if applicable), credit card information (if applicable), and special instructions. This information is collected and sent to restaurants for several reasons, including:

• - To instruct the restaurant on your order request and order details,
• - To automatically email you a copy of your online order,
• - To charge your credit card ahead of time for delivery orders,
• - To allow the restaurant to contact you via phone or email to confirm your request,
• - To provide ClickEats with an email and phone number in case we need to contact you for customer service purposes associated directly with your order.

A copy of your order will be emailed to the email address submitted, and a copy will be kept in your My Account page.

Reservation Requests

For Unregistered Users, you provide your name, contact number and email address. This information is collected and sent to restaurants for several reasons, including:

• - To automatically email you a copy of your reservation request,
• - To allow the restaurant to contact you via phone to confirm your request,
• - To provide ClickEats with an email and phone number in case we need to contact you for customer service purposes associated directly with the reservation.

For Registered Users, you provide the same information as provided by Unregistered Users for the reasons stated above. In addition, you establish an account by providing a password and confirming the password. Registered Users then receive an email message confirming their status as a Registered User. Registered Users can view and update their account information (My Account), and view their transaction history in the My Requests section of the Site.

User Account

Registered Users can choose to create their restaurants and notes (My Restaurants and Notes) and other personal information in the My Account section of the Site. This information is primarily used to assist you in finding information, making requests quickly and to provide you with customized offers.

Newsletters

You may elect to receive updates from us about special offers, new ClickEats restaurant partners, and other noteworthy news items. However, you must opt-in to these emails and you may always choose to decline to receive these email messages. We will never sell, rent or share your personal information, including your email or phone number with and third parties for marketing purposes without your express permission. We may share your personal information with our service delivery providers for the purpose of delivering our to you, or as required by law.

Unsubscribing to Newsletters

You may unsubscribe from the ClickEats email list at any time by following the directions provided in the email communications, by sending an email to info@clickeats.com with “Unsubscribe” in the subject line, or by visiting you’re My Account page and choosing to opt out from receiving marketing communications.

Information Sharing

Legal Disclaimer

Although we make every effort to preserve your privacy, ClickEats may be required by law to disclose information you have provided in obtaining our services. ClickEats may also disclose information against someone who poses a threat to ClickEats interests (such as customer fraud) or whose activities could bring harm to others.

Online Order Information Shared with Resturants

When you make an Online Order using ClickEats.com, your name, email address and contact phone number, along with your order details, are provided to the selected restaurant. If you choose delivery with payment by credit card, we also provide the restaurant with your credit card information so they can process your credit card, ahead of the delivery time. If you have indicated that you are interested in receiving emails from that restaurant, this information is also made available to the restaurant. You also have the option of providing special preferences or comments regarding your order, which ClickEats will pass on to that restaurant.

ClickEats will only share the information specified above with the restaurant at which you have made your online order. Restaurants cannot use the ClickEats System to access information pertaining to diners or dining histories from other restaurants, with the exception that restaurants under the same corporate ownership may elect to share diner information between restaurant properties.

Restaurants may view reports of their online order requests, including all of the information indicated above.

Reservation Information Shared with Restaurants

When you make a restaurant reservation request using ClickEats.com, your name, email address and contact phone number, along with your reservation details, are provided to that restaurant. If you have indicated that you are interested in receiving emails from that restaurant, this information is also made available to the restaurant. You also have the option of providing special preferences or comments regarding your reservation, which ClickEats will pass on to that restaurant.

ClickEats will only share the information specified above with the restaurant at which you have made reservations. Restaurants cannot use the ClickEats System to access information pertaining to diners or dining histories from other restaurants, with the exception that restaurants under the same corporate ownership may elect to share diner information between restaurant properties.

Restaurants may view reports of their reservation requests, including all of the information indicated above.

How Restaurants May Use Your Information

All ClickEats current and former partner restaurants have agreed that they will not sell, rent or share your personal information, including your email or phone number, with and third parties for marketing purposes without your expressed written permission.

However, we encourage you to review the information privacy practices of any restaurants whose online orders or reservations you make on ClickEats.com. In addition, these restaurants may also contact you as necessary to obtain additional information about your confirmed order or reservation.

Email from Restaurants

You may consent to receive marketing communications from the restaurant at which you've made an online order, reservation or other request. If you have subscribed to a restaurant’s email using the ClickEats.com website and would like to unsubscribe from that restaurant's marketing communications, you can go to the My Account page and opt out, or you can contact the appropriate restaurant directly.

Please be aware that we may have links to other websites on our Site that may collect personally identifiable information about you. This Privacy Policy does not cover the information practices or policies of such websites. ClickEats does not share the personal information we obtain from you with third parties at these websites.

Information Used to Enhance the User Experience

Cookies

Cookies are small pieces of information stored on your computer with information about your visit to a particular site. Our session cookies, which are erased once you close the browser window, do not contain any personal data. Login areas on the ClickEats website require that your browser accept cookies.

We use cookies to verify that you are properly signed in and to display your saved information, such as My Restaurants and Notes, for example. Please be aware that a cookie cannot spread computer viruses, retrieve any other data from your hard drive, or capture your email address.

You can erase or block cookies from your computer if you wish to do so (your internet browser help screen or manual will thoroughly explain this process), but certain advanced features, as well as parts of the website, may not work correctly or will not work at all if your browser is set not to accept cookies.

Log Files

Like most standard website servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track general user movement (as a whole rather than as individuals), diagnose problems with our servers and gather broad demographic information. IP addresses and log files are not linked to personally identifiable information.

Security Information

We use both technical and procedural methods to maintain the integrity and security of our data. We use industry standard encryption technologies, such as 128 bit SSL encryption, when transferring and receiving private consumer data on our website. This information can only be translated once it's received by our secure servers. These secure servers help to protect against the loss, misuse or alteration of information that we have collected from you through our Web site. The servers that store personally identifiable information are in a secure environment, in a locked facility.

Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which personally identifiable information is stored, are kept in a secure, access-controlled environment.

Policy Changes

If we decide to change our policies, we will add those changes to this Privacy Policy and other places on the Site we deem appropriate so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the Privacy Policy under which the information was collected.

If, however, we are going to use your personally information in a manner different from that stated at the time of collection, we will notify you via email. Users will have a choice as to whether or not we use their information in this different manner. However, if you have opted out of all communication with the Site, or deleted/deactivated your account, then you will not be contacted, nor will your personal information be used in this new manner.

Updating, Deleting, Deactivating Personal Information

If a Registered User’s personally identifiable information (such as zip code, phone, email or postal address) changes or if a user no longer desires our services, we provide a way to correct, update or delete/deactivate user's personally identifiable information. Registered Users can change your personal information on the My Account page of our Site.
